These Terms & Conditions ("Terms") govern your access to and use of the Good Mood Brews website at www.goodmoodbrews.com (the "Site") and any orders you place for Good Mood Brews products (the "Products"). By using the Site or placing an order, you agree to be bound by these Terms.
Good Mood Brews is operated from the State of California.
1. Eligibility
You must be at least 18 years old and able to form a legally binding contract to place an order. By placing an order, you represent that you meet these requirements and that all information you provide is true, accurate, and complete.
2. The Products
Good Mood Brews produces craft nutritional beverages in California. Our Products are food items intended for general wellness and enjoyment. They are not drugs, dietary supplements regulated as drugs, or medical treatments.
Health & Safety. Statements about our Products have not been evaluated by the U.S. Food and Drug Administration. Our Products are not intended to diagnose, treat, cure, or prevent any disease. Consult a qualified healthcare professional before using our Products if you are pregnant, nursing, taking medication, have a medical condition, or are giving the Product to a child. Always read the label and ingredient list, particularly if you have allergies or sensitivities.
3. Limited Availability & Allocation
Good Mood Brews Products are produced in small, limited batches. Inventory for each release is finite, allocated in advance to fulfill orders, and may sell out quickly. Because every confirmed order draws from a fixed allocation, an order placed and confirmed cannot be returned to general inventory once fulfillment has begun.
We reserve the right to limit quantities per customer, refuse or cancel any order at our sole discretion, and to correct pricing or availability errors at any time before shipment.
4. Orders, Pricing & Payment
All prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes will be calculated at checkout based on your shipping address.
Submitting an order constitutes an offer to purchase. We accept your offer only when we issue an order confirmation; we may decline or cancel any order at any point before shipment, including for suspected fraud, errors, or supply constraints.
You authorize us (and our payment processor) to charge the payment method you provide for the total order amount, including taxes and shipping. If a charge is declined or reversed, your order may be cancelled.
5. Shipping
Shipping terms, carriers, processing times, and delivery-issue procedures are described in our Shipping Policy, which is incorporated into these Terms by reference. Title and risk of loss for Products pass to you upon delivery to the carrier.
6. All Sales Final — No Returns or Refunds
ALL SALES ARE FINAL. Because Good Mood Brews Products are perishable food items produced in limited runs with finite capacity, all sales are final. We do not accept returns, exchanges, or refunds once an order has been confirmed and shipped, except where the Product is damaged or defective in transit (see Section 7). This policy is disclosed before purchase and you acknowledge it at checkout.
This no-return policy reflects:
- Food-safety requirements that prohibit us from accepting, reselling, or restocking returned beverage product;
- The limited-run nature of our production, which allocates inventory to confirmed orders and leaves no buffer for restocks;
- Industry-standard practice for direct-to-consumer perishable beverages.
Cancellation requests submitted before an order enters fulfillment may be accommodated at our discretion. Once an order has been packed, labeled, or handed to a carrier, it can no longer be cancelled.
7. Damaged or Defective Product (Sole Exception)
If your Product arrives damaged in transit, leaking, broken, expired on arrival, or otherwise defective, we will replace it or, at our discretion, issue a refund. To qualify, you must:
- Contact us at support@goodmoodbrews.com within seven (7) calendar days of delivery;
- Include your order number;
- Include clear photos of the damaged or defective Product and the shipping carton (including any visible carrier damage);
- Retain the Product and packaging until your claim is resolved.
Claims submitted outside this window or without supporting evidence may not be honored. This Section 7 is your sole and exclusive remedy for damaged or defective Product.
8. Cancellations & Modifications
Orders may be cancelled or modified only before fulfillment begins. To request a cancellation or change, email us immediately at the address above with your order number. We cannot guarantee changes once an order enters fulfillment.
9. Promotions & Discounts
Discount codes and promotions are subject to terms posted at the time of the offer. Codes cannot be combined unless expressly stated, are not redeemable for cash, and may be revoked at any time.
10. Intellectual Property
All content on the Site, including the Good Mood Brews name, logos, packaging, photography, recipes, copy, and trade dress, is owned by or licensed to Good Mood Brews and is protected by U.S. and international intellectual property laws. You may not reproduce, modify, distribute, or commercially exploit any portion of the Site or Products without our prior written permission.
11. User Conduct
You agree not to use the Site to:
- Violate any applicable law or regulation;
- Submit false, fraudulent, or misleading information;
- Interfere with or attempt to compromise the security or integrity of the Site;
- Use the Site to harass, abuse, or harm another person;
- Engage in any automated scraping, data harvesting, or reverse engineering.
12. Disclaimers
THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GOOD MOOD BREWS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the limitation of certain damages, so portions of this section may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless Good Mood Brews and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site or Products, or your violation of any law or third-party right.
15. Governing Law & Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 16, the state and federal courts located in Los Angeles County, California have exclusive jurisdiction over any dispute that is not subject to arbitration.
16. Dispute Resolution
Informal resolution first. Before filing any claim, you agree to contact us at support@goodmoodbrews.com and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration. If the dispute is not resolved, any controversy or claim arising out of or relating to these Terms or the Products will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in Los Angeles County, California, or by video conference. The arbitrator's decision will be final and may be entered in any court of competent jurisdiction.
Class action waiver. You and we agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Small-claims carve-out. Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction.
17. Changes to These Terms
We may update these Terms from time to time. The version posted on the Site at the time you place an order governs that order. Material changes take effect upon posting and, where required, with notice to you.
